OFFICIAL CHALLENGE RULES

Isthmus Canada(the “Sponsor” or “Isthmus”) “120 Challenge” (the “Challenge”)

The Challenge will run from March 1, 2019 until March 20, 2019 (the “Challenge Period”). To be eligible, entries must be received on or before 11:59 p.m. (EST) on March 20, 2019 (the “Challenge Closing Date”).

HOW TO ENTER

In order to enter and participate in the Challenge, you must:

1. Follow isthmus on your social media platform (Facebook, Twitter, or Instagram);

2. Post a photo of yourself holding a sign that says “I stand with Cory Joseph against childhood hunger”;

3. Include the hashtag #120Challenge in your post; and

4. Tag 5 friends in your post.

You must include the hashtag so that the Sponsor can retrieve your entry.

Every post which meets the above four requirements is one (1) entry into the Challenge.

All photographs must be posted on social before the Challenge Closing Date in order to be eligible.

By entering the Challenge, entrants express their permission for their Challenge entry to be shared on Cory Joseph and the Sponsor’s social media assets.

Photographs may not be or include anything that is hateful, offensive, threatening, pornographic, deceptive or misleading and must display conduct and content appropriate for posting on a public website.  Entrants may not post photographs of or including a minor person, unless valid parent/guardian consent is document in writing before the post is made.  All entries based on any photographs removed from posting because the photograph is contrary to any posting requirements whether provided in these Rules or otherwise, will be disqualified and removed from the Challenge and not eligible to win the Prize.  All decisions concerning the suitability or appropriateness of any photograph are solely that of the Sponsor.  Any photographs removed from posting by any website or social media provider shall been deemed to be ineligible for the Challenge and the entrant shall be disqualified from the Challenge.

The entrant shall be deemed to be the person with the account from which the photograph was posted.  In the event of a dispute regarding who submitted the entry, the entry will be deemed submitted by the authorized account holder of the address connected to the posting of the photograph. An authorized account holder is the natural person who is assigned to an e-mail address by an internet service provider or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address in question. A potential winner may be required to show proof that the person is the authorized account holder. 

NO PURCHASE NECESSARY

To obtain one (1) Challenge entry without making an online entry, print your name, email address, mailing address and telephone number clearly and legibly on a plain piece of paper and describe in a minimum 50-word unique and original handwritten essay what charitable initiatives are important to you and mail it in an envelope with sufficient postage to Isthmus “120 Challenge”, 229 Niagara Street, Toronto, ON M6J2L5.

To be eligible, your mail-in request must be received by March 19, 2019 and will become the property of the Sponsor. Limit of one (1) no online entry request per household during the Challenge Period. Duplicate essays or requests will be discarded.

ELIGIBILITY

This Challenge is open to all residents of Canada, excluding residents of Quebec, who are not employees of, members of the immediate family, or domiciled with an employee of Isthmus, its subsidiaries, parent or affiliated companies, their respective advertising or promotional agencies, or the independent Challenge organization. Proof of identification and age must be provided upon request. In these Rules, “immediate family” means spouse, mother, father, sister, brother, son and daughter.

The winner must either be the age of majority in their province/territory of residence, or be accompanied by an adult that is 19+ who has written permission from the parent/guardian of each individual under 18 attending. The winner can choose to use one of their six tickets for the 18+ attendee, or they can accompany at their own expense.  Anyone travelling with the Prize winner must complete a Declaration and Release form, as outlined below.

THE PRIZE

There is one (1) prize available (“Prize”), which consists of:

    1. Six (6) round-trip economy class tickets to Indianapolis, Indiana, USA (the winner and all companions must fly to/from the same airport in Canada);

    2. One (2) night’s accommodation at The Alexander Hotel in Indianapolis, Indiana, USA, April 6-7, 2019 (two hotel rooms, with three people in each room);

    3. Six (6) tickets to Indiana Pacer’s game on April 5, 2019; and

Approximate retail value of the Prize is $5,500 CAD.

A random draw will be conducted by the Sponsor in Toronto, Ontario at 10:00AM on March 21, 2019, from among all eligible entries received.

At least one person travelling must be at least the age of majority in his/her province/territory of residence. Anyone under the age of majority must the express written consent (in form and substance satisfactory to the Sponsor, in its sole and absolute discretion) to accompany the confirmed winner on the Prize trip.

Prize winner and companions must have valid travel documents prior to departure or Prize will be forfeited. Winner is solely responsible for obtaining and/or renewing travel documents in order to travel.  The Contest Sponsor assumes no liability for ensuring winner and/or companions are eligible/able to travel. Certain restrictions may apply to air travel, and air travel reservations are subject to availability.  Air carrier’s regulations and conditions apply.

Winners and their companions must travel on the same itinerary. The cost of travel by the winner and companions to and from the winner’s and companion’s residences and the point of departure is solely the responsibility of the winner. All expenses other than those specifically referred to above, including but not limited to meals, beverages, gratuities, ground transportation, travel and health insurance, excess baggage fees, communications charges, and all other incidentals are the responsibility of the winner and their companions.

No changes will be permitted to travel dates or passenger names once the travel portion of Prize has been booked. The Sponsor reserves the right to designate all transportation particulars and routes.

The Sponsor reserves the right to substitute a prize of equal or greater value for the Prize. Hotel accommodations are six people to sleep in two hotel rooms. Winner may be required to present a valid major credit card in winner's name at the time of hotel check-in to cover any incidental expenses.

Flights and hotel accommodation are subject to change without notice or compensation. Prize winner and his/her travel companions are solely responsible for all costs not specifically included herein including, without limitation, all parking, transportation to and from the local airport nearest the winner’s place of residence (all companions must also fly through the same airport at the winner), all meals, beverages, room service, any items of a personal nature, departure and/or applicable taxes or fees, currency exchange costs, baggage handling, gratuities, merchandise, telephone calls, laundry, custom tour add-ons, optional activities extras, travel and/or medical insurance, appropriate travel documentation, visa, etc. Any additional costs incurred in collecting and using the Prize are also the responsibility of the winner and companions.

The Prize must be accepted as awarded and is not transferable or convertible to cash. The Sponsor reserves the right to substitute a prize of equal or greater value in the event that any of the Prize is not available due to circumstances beyond its control.

The odds of winning the Prize depends on the total number of eligible entries received by the Challenge Closing Date.

Selected entrants from qualifying Facebook, Twitter, and Instagram entries will be contacted by private message. Mail-in selected entrants will be notified by email or phone. In order to be declared a winner, a selected entrant must first correctly answer, without assistance of any kind, mechanical or otherwise, a time-limited mathematical skill-testing question to be administered by the Sponsor and sign a Declaration and Release form confirming compliance with the Challenge rules and acceptance of the prize as awarded and a Release.

DECLARATION AND RELEASE

Both the winner and the companions will be required to sign a Declaration and Release with the official Challenge rules and a Publicity/Liability Release releasing the Sponsor, its affiliates, subsidiaries, parent and related companies, their respective advertising and promotional agencies, and all of their respective directors, officers, owners, partners, employees, participating retailers, agents, representatives, successors and assigns (collectively, the “Releasees”) from any actions, causes of action, suits, debts, claims, demands and liability whatsoever in connection with this Challenge or the acceptance and/or use or misuse of any prize, including, without limitation, claims based on negligence, breach of contract and fundamental breach and liability for physical injury, death or property damage which any entrant, his/her administrators, heirs, successors or assigns has or might have by reason of or arising out of the entrant’s participation in this Challenge and/or in connection with the acceptance and/or use or misuse of the Prize. The Declaration and Release documents will also release, discharge, indemnify, and hold harmless Facebook, Twitter, Instagram or any other social media platform from any and all liability, claims, or damages, demands, actions, or causes of action whatsoever.

Declaration and Release documents must be returned within ten (10) business days of the date of the notification or the prize may be forfeited, at the discretion of the Sponsor. Only once all documents have been completed by the potential winner and verified by the Sponsor, will the potential winner be officially declared a winner and receive the Prize.

By entering the Challenge and accepting a prize, the winner and the companions consent to the use of his/her name, address, voice, statement and photograph or other likeness, without further compensation, in connection with any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever including print, broadcast or via the Internet.

If a selected entrant fails to correctly answer, unaided, the time-limited skill-testing question; fails to return the properly executed Declaration and Release documents within the specified time; and/or cannot or is, for any reason unable to, accept the Prize as awarded for any reason; then the selected entrant will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to select an alternate selected entrant from among the remaining eligible entries (in which case the foregoing provisions of this section shall apply to the newly selected potential winner).

GENERAL

By entering the Challenge, each entrant agrees to abide by the official Challenge rules and the decisions of the Sponsor, which shall be final and binding, without right of appeal, in respect to all matters relating to this Challenge including, without limitation, as to eligibility and/or disqualification of entries. In the event it is determined that an entrant has entered in a manner that is not sanctioned by these Challenge rules and/or has otherwise not complied with these rules, such entrant shall be disqualified. Mechanically reproduced entries will not be eligible or accepted and will be deemed to be null and void. The Sponsor assumes no responsibility for incomplete, illegible, damaged, destroyed, lost, late, stolen, falsified, delayed or misdirected or insufficient postage requests for entries, all of which shall be treated as void. Furthermore, the Sponsor shall not be responsible for any problems, errors or negligence that may arise or occur in connection with the Challenge including, but not limited to, inaccurate or incomplete capture of entry information, or any failure of the website during the promotional period, including, without limitation, as a consequence of any problems or technical malfunction of any kind, including, without limitation, in respect to computer equipment, hardware, software, human or technical errors, printing errors, lost, delayed, failed, incomplete or garbled data, communications or transmissions, interruptions, deletions, defects or failure of any telephone or computer lines or networks, computer online systems or servers or access providers, or failure of any e-mail or entry to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including, without limitation, any injury or damage to an entrant's or any other person's computer related to or resulting from playing or downloading any material in the promotion, or errors in advertising, the selection and announcement of winner, and/or the awarding of the Prize.

The Sponsor reserves the right, in its sole discretion, to cancel or suspend the Challenge should a virus, bug, or other cause beyond the reasonable control of the Sponsor, corrupt the security or proper administration of the Challenge. Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, irregular, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way or have been submitted through illicit means or do not conform with or satisfy any and all terms and conditions of these official rules.

In the event of a dispute as to the identity of a winner based on an email address, the winning entry will be deemed to be made by the authorized account holder of the email address at the time of entry. Authorized account holder is the natural person who was assigned an email address by an internet access provider, online service provider or other organization responsible for assigning email addresses for the domain name associated with the submitted email address.

All entries become the property of the Sponsor and none will be returned. No communication will be entered into except with a potential winner.

The Sponsor reserves the right to terminate this Challenge or to amend these Challenge rules at any time without notice or with notice in major national newspapers if any factor interferes with the proper conduct of the Challenge as contemplated by these official rules. The Sponsor reserves the right to make substitutions for all or any component of any prize. This Challenge is subject to all applicable federal, provincial and municipal laws and regulations. Void where prohibited. 

The Challenge is not associated with the National Basketball Association or the Indiana Pacers. The Challenge is facilitated through the Sponsor, Isthmus, in partnership with Cory Joseph.

The Challenge is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, or Instagram.

The Sponsor respects your personal information. We will only collect and use your personal information for the purposes of administering this Challenge.
